Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily concerned with (...) the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. According to the traditional nomological-deductive methodology of physics and chemistry [Hempel and Oppenheim, 1948], explaining a phenomenon means subsuming it under a law. Logic becomes then the glue of explanation and laws the primary explainers. Thus, the scientific study of a system would consist in the development of a logically sound model of it, once the relevant observables (state variables) are identified and the general laws governing their change (expressed as differential equations, state transition rules, maximization/minimization principles,. . . ) (...) are well determined, together with the initial or boundary conditions for each particular case. Often this also involves making a set of assumptions about the elementary components of the system (e.g., their structural and dynamic properties) and modes of local interaction. In this framework, predictability becomes the main goal and that is why research is carried out through the construction of accurate mathematical models. Thus, physics and chemistry have made most progress so far by focusing on systems that, either due to their intrinsic properties or to the conditions in which they are investigated, allow for very strong simplifying assumptions, under which, nevertheless, those highly idealized models of reality are deemed to be in good correspondence with reality itself. Despite the enormous success that this methodology has had, the study of living and cognitive phenomena had to follow a very different road, because these phenomena are produced by systems whose underlying material structure and organization do not permit such crude approximations. Seen from the perspective of physics or chemistry, biological and cognitive systems are made of an enormous number of parts or elements interacting in non-linear and selective ways, which makes very difficult their tractability through mathematical models. In addition, many of those interacting elements are hierarchically organized, in a way that the “macroscopic” (observable) parts behave according to rules that cannot be, in practice, derived from simple principles at the level of their “microscopic” dynamics.. An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

In The Case for Animal Rights, Tom Regan argues that although all subjects-of-a-life have equal inherent value, there are often differences in the value of lives. According to Regan, lives that have the highest value are lives which have more possible sources of satisfaction. Regan claims that the highest source of satisfaction, which is available to only rational beings, is the satisfaction associated with thinking impartially about moral choices. Since rational beings can bring impartial reasons to bear on decision making, (...) Regan maintains that they have an additional possible source of satisfaction that nonrational beings do not have and, consequently, the lives of rational beings turn out to have greater value.. Recent discussions in the just war literature suggest that soldiers have a duty to assume certain risks in order to protect the lives of all innocent civilians. I challenge this principle of risk by arguing that it is justified neither as a principle that guides the conduct of combat soldiers, nor as a principle that guides commanders in the US military. I demonstrate that the principle of risk fails on the first account because it requires soldiers both to violate their (...) strict duty of obedience and loyalty and to exceed their special obligations to protect their fellow comrades, the state, the state's constituents and other protected civilians. I then illustrate that the principle of risk fails on the second account since it conflicts with the commander's primary obligation to protect and promote the welfare and lives of his or her soldiers. I conclude by arguing that we cannot reasonably expect soldiers and commanders to adhere to the principle of risk until there is a radical, institutional-level transformation of militaristic goals, values, strategies, policies, warrior codes and expectations of service members in the US Armed Forces. Este estudio tiene como objetivo identificar la tipología y los patrones de los mensajes desinformativos relacionados con la salud y la nutrición que se difundieron durante la primera etapa de la pandemia COVID-19 (marzo-noviembre de 2020). Para ello, se realizó un estudio cuantitativo exploratorio con dos tipos de datos. Los primeros provienen del estudio de 95 documentos (artículos científicos) hallados en la base de datos SCOPUS a través de búsquedas booleanas con los términos desinformación, engaño, salud y nutrición. A estos (...) documentos se les aplicó un formulario de registro, indicando los siguientes ítems: a) el tema del artículo (salud o nutrición); b) el tipo de mensaje erróneo (desinformación o engaño); c) el país en el que se realizó el estudio; d) el tipo de participantes (público general, jóvenes, ancianos, profesionales de la salud, estudiantes universitarios); y e) el tipo de canal de información estudiado (Twitter, Facebook, YouTube, Instagram, periódicos impresos, periódicos digitales, plataformas web, televisión, entre otros). Por otro lado, se seleccionaron 95 ingredientes o alimentos que fueron diseminados vía WhatsApp en diferentes bulos en español durante el primer mes de confinamiento (marzo-abril de 2020). Se aplicó un formulario para evaluar el contenido de los engaños, identificando: a) el tipo de sustancia o alimento (fruta, verdura, legumbre, nuez, hierba, entre otros); y b) las fuentes de información a las que se refirió el engaño (autoridades sanitarias, público general, organismos médicos, entre otros). Finalmente, los resultados de ambos estudios cuantitativos concluyeron que el patrón internacional de difusión de bulos fue principalmente sobre la salud en general, y que la desinformación sobre nutrición fue minoritaria, y en el 91% de los casos estuvo relacionada con la ingesta de frutas y verduras, afirmando que podrían prevenir o curar la COVID-19, sin ninguna evidencia científica. In this piece, we articulate the "collaborative autoethnographic practice" we utilized to illustrate the complexities of mothering that involved: (a) individually writing autoethnographic narratives on mothering, (b) sharing these autoethnographic narratives in a public forum, (c) publicly discussing the heuristic commonalities across these autoethnographic narratives, (d) tying those commonalities back to the literature, and (e) revisiting the autoethnographic narratives for aspects of social critique where our autoethnographic narratives (intentionally or unintentionally) hegemonicaly reproduced cultural scripts. We argue that presenting knowledge of (...) mothering in this way, through collaborative autoethnographic practice, creates a myriad of opportunities for growth and self-reflexivity, and our stories illuminate a part of our existence that often remains unexamined in other methodologies. Background Neuroscientific approaches have historically triggered changes in the conception of creativity and artistic experience, which can be revealed by noting the intersection of these fields of study in terms of variables such as global trends, methodologies, objects of study, or application of new technologies; however, these neuroscientific approaches are still often considered as disciplines detached from the arts and humanities. In this light, the question arises as to what evidence the history of neurotechnologies provides at the intersection of creativity (...) and aesthetic experience. Methods We conducted a century-long bibliometric analysis of key parameters in multidisciplinary studies published in the Scopus database. Screening techniques based on the PRISMA method and advanced data analysis techniques were applied to 3612 documents metadata from the years 1922 to 2022. We made graphical representations of the results applying algorithmic and clusterization processes to keywords and authors relationships. Results From the analyses, we found a) a shift from a personality-focus quantitative analysis to a field-focus qualitative approach, considering topics such as art, perception, aesthetics and beauty; b) The locus of interest in fMRI-supported neuroanatomy has been shifting toward EEG technologies and models based on machine learning and deep learning in recent years; c) four main clusters were identified in the study approaches: humanistic, creative, neuroaesthetic and medical; d) the neuroaesthetics cluster is the most central and relevant, mediating between creativity and neuroscience; e) neuroaesthetics and neuroethics are two of the neologism that better characterizes the challenges that this convergence of studies will have in the next years. Conclusions Through a longitudinal analysis, we evidenced the great influence that neuroscience is having on the thematic direction of the arts and humanities. The perspective presented shows how this field is being consolidated and helps to define it as a new opportunity of great potential for future researchers. (shrink)

Because factory-farmed meat production inflicts gratuitous suffering upon animals and wreaks havoc on the environment, there are morally compelling reasons to become vegetarian. Yet industrial plant agriculture causes the death of many field animals, and this leads some to question whether consumers ought to get some of their protein from certain kinds of non factory-farmed meat. Donald Bruckner, for instance, boldly argues that the harm principle implies an obligation to collect and consume roadkill and that strict vegetarianism is thus immoral. (...) But this argument works only if the following claims are true: all humans have access to roadkill, roadkill would go to waste if those who happen upon it don’t themselves consume it, it’s impossible to harvest vegetables without killing animals, the animals who are killed in plant production are all-things-considered harmed by crop farming, and the best arguments for vegetarianism all endorse the harm principle. As I will argue in this paper, each claim is deeply problematic. Consequently, in most cases, humans ought to strictly eat plants and save the roadkill for cats. (shrink)

There is consensus that children have questionable decisional capacity and, therefore, in general a parent or a guardian must give permission to enroll a child in a research study. Moreover, freedom from duress and coercion, the cardinal rule in research involving adults, is even more important for children. This principle is embodied prominently in the Nuremberg Code (1947) and is embodied in various federal human research protection regulations. In a program named "SATURN" (Student Athletic Testing Using Random Notification), each school (...) in the Oregon public-school system may implement a mandatory drug-testing program for high school student athletes. A prospective study to identify drug use among student-athletes, SATURN is designed both to evaluate the influence of random drug testing and to validate the survey data through identification of individuals who do not report drug use. The enrollment of students in the drug-testing study is a requirement for playing a school sport. In addition to the coercive nature of this study design, there were ethically questionable practices in recruitment, informed consent, and confidentiality. This article concerns the question of whether research can be conducted with high school students in conjunction with a mandatory drug-testing program, while adhering to prevailing ethical standards regarding human-subjects research and specifically the participation of children in research. Investigates the resolution of contradictions and ambiguous derogations in a code, by means of the imposition of partial orderings. Although formulated as a study in the logic of norms, it provided the initial ideas for work on the logic of theory (or belief) change, developed by the authors in a series of papers by the authors and Peter Gardenfors beginning in 1985.

Because spaying/neutering animals involves the harming of some animals in order to prevent harm to others, some ethicists, like David Boonin, argue that the philosophy of animal rights is committed to the view that spaying/neutering animals violates the respect principle and that Trap Neuter Release programs are thus impermissible. In response, I demonstrate that the philosophy of animal rights holds that, under certain conditions, it is justified, and sometimes even obligatory, to cause harm to some animals in order to prevent (...) greater harm to others. As I will argue, causing lesser harm to some animals in order to prevent greater harm to others, as TNR programs do, is compatible with the recognition of the inherent value of the ones who are harmed. Indeed, we can, and do, spay/neuter cats while acknowledging that they have value in their own right. (shrink)

Higher-order thought theories maintain that consciousness involves the having of higher-order thoughts about mental states. In response to these theories of consciousness, an attempt is often made to illustrate that nonhuman animals possess said consciousness, overlooking an alarming consequence: attributing higher-order thought to nonhuman animals might entail that they should be held morally accountable for their actions. I argue that moral responsibility requires more than higher-order thought: moral agency requires a specific higher-order thought which concerns a belief about the rightness (...) or wrongness of affecting another’s mental states. This “moral thought” about the rightness or wrongness is not yet demonstrated in even the most intelligent nonhuman animals, thus we should suspend our judgments about the “rightness” or “wrongness” of their actions while further questioning the recent insistence on developing an animal morality. Overview The evolution of multicellularity raises questions regarding genomic and developmental commonalities and discordances, selective advantages and disadvantages, physical determinants of development, and the origins of morphological novelties. It also represents a change in the definition of individuality, because a new organism emerges from interactions among single cells. This volume considers these and other questions, with contributions that explore the origins and consequences of the evolution of multicellularity, addressing a range of topics, organisms, and experimental protocols. Each section focuses on (...) selected topics or particular lineages that present a significant insight or challenge. It is common for conservationists to refer to non-native species that have undesirable impacts on humans as “invasive”. We argue that the classification of any species as “invasive” constitutes wrongful discrimination. Moreover, we argue that its being wrong to categorize a species as invasive is perfectly compatible with it being morally permissible to kill animals—assuming that conservationists “kill equally”. : President Clinton's charge to the Advisory Committee on Human Radiation Experiments included the identification of ethical and legal standards for evaluating government-sponsored radiation experiments conducted during the Cold War. In this paper, we review the traditional account of the history of American research ethics, and then highlight and explain the significance of a number of the Committee's historical findings as they relate to this account. These findings include both the national defense establishment's struggles with legal and insurance issues concerning (...) human experiments, and the medical profession's perspective on human experimentation in the years following the Nuremberg Medical Trials. We conclude that the Committee's work both enriches the traditional view of the history of research ethics and opens important new areas for study. (shrink)

Paul Crowther, in his book, The Kantian Sublime (1989), works to reconstruct Kant's aesthetics in order to make its continued relevance to contemporary aesthetic concerns more visible. The present article remains within the area of Crowther's "cognitive" sublime, to show that there is much space for expanding upon Kantian varieties of the sublime, particularly in art.

Merleau-Ponty hat in keiner seiner Schriften eine systematische Hermeneutik ausgearbeitet, doch finden sich in fast allen seinen Arbeiten Bemerkungen über hermeneutisch relevante Sachverhalte. Dies gilt vornehmlich für Passagen über die Erfahrung anderer Subjektivität, über die dialogische Erfahrung und über das Produzieren und Verstehen sprachlicher Äusserungen. In diesem Beitrag wird versucht, Merleau-Ponty's Auffassungen hinsichtlich der Fragen nach Sinn, Genesis und Struktur des Verstehens vorzustellen. Hierbei wird in erste Linie das Problem berücksichtigt, was sich eigentlich vollzieht, wenn man als Leser die Bekanntschaft (...) eines klassischen, bzw. ursprünglichen Werkes macht. Das Werk spricht eine neue Sprache (parole parlante, langage conquérante), die die vorgegebene Sprache (parole parlée, langage institué) neugestaltet, so wie auch die in der neuen Sprache sich niederschlagende Erfahnings- und Gedankenwelt unsere alten Gedanken auflöst und uns eine neue Sicht auf die Wirklichkeit vermittelt. Hermeneutisch relevant ist, dass der Sinn dieser parole pensante, bzw. der pensée parlante niemals vollständig gegeben ist, noch auch durch welche Auslegung dann auch je erschöpft werden kann. Das bei der Lektüre eines solchen ursprünglichen Werkes sich bildende primäre Verständnis ist als Grundlage einer sekundären Verstehensleistung anzusehen, die das Thema der Hermeneutik, insofern sie Auslegungskunst ist, darstellt. Die Rekonstruktion des ursprünglichen Sinnes eines solchen Werkes ist in den Augen Merleau-Ponty's nicht nur in ihrer Möglichkeit beschränkt, sie ist vielmehr auch nur von untergeordneter Bedeutung. Was das erste betrifft, so sieht sich jeder solcher Rekonstruktionsversuch, (der bei der Restitution des ursprünglichen Textsinnes auch die Biographie des Autors und den historischen Kontext zu berücksichtigen hat – das Werk muss ja als Antwort auf Fragen verstanden werden, die sich im Lebenszusammenhang einer Zeit gestellt haben –) mit der Tatsache konfrontiert, dass die Gedanken und Erfahrungen, die sich in einem Werk niedergeschlagen haben, häufig so sehr miteinander verwoben sind, zum andern sich im Laufe des Lebens ihres Urhebers sich verändern, dass ihre völlige Inventarisierung zu einer unmöglichen Aufgabe wird. Zudem gehört zum Sinn eines solchen Werkes auch die Wirkung, die es in der Nachwelt hervorgerufen hat. So ist der „Wahre Descartes” keine gleichsam sich selbst erhellende Ganzheit, kein absoluter Entwurf im Sinne Sartres – sondern das Ganze von Leben, Werk und Interpretationen, das niemals definitiv entziffert werden kann. Für Merleau-Ponty ist der Sinn in fortwährendem Werden begriffen. Hierin ist jedoch auch die Bedeutung der wahren Interpretation, bzw. des wahren Denkens gelegen. Wichtiger als die in sich begrenzte Möglichkeit der Rekonstruktion ist dann auch das „penser derechef”. Merleau-Ponty beruft sich ausdrücklich auf einen Gedanken von Heidegger, demzufolge der Sinn des Denkens vor allem darin gelegen ist, das noch Ungesagte und Ungedachte in einem klassischen Werk zu entfalten. In der Tat prägt dies auch die Weise, in der Merleau-Ponty mit dem Werk Husserls oder anderer Denker umgeht. Es ist Merleau-Ponty leider nicht mehr gegeben gewesen, die rudimentären Bemerkungen über die Geschichte der Philosophie, die sich in seinem letzten Werk finden, weiter auszuarbeiten, noch auch alle Konsequenzen seiner Hermeneutik zu durchdenken, in der das Fundament der Wahrheit sowohl in der Zeit lokalisiert bleibt als auch zugleich einer die Zeit überspannenden Teleologie eingefügt ist.
